MSIC issuing bodies have the ability to extend an MSIC if you relied upon a visa to show your right to work in Australia when you applied for your initial MSIC.
If your MSIC is due to expire or has expired due to your expiring/expired visa, a new MSIC can be issued based on your initial application as long as:
The maximum period that your MSIC can be extended is dependent upon your initial MSIC validity period. This may vary from two years up to four years from your initial approval date.
To replace your MSIC based on you new visa, you must complete the below process.
Relevant section of the Maritime Transport and Offshore Facilities Security Regulations (2003).
6.08LA Special arrangements for persons with visa extensions
An issuing body may issue an MSIC to a person, if the person:
1) was the holder of an MSIC (the old MSIC) that expired because the person’s visa (the old visa) has expired; and
2) holds a new visa entitling him or her to work in Australia, that was issued less than 12 months after the expiry of the old visa; and
3) has an operational need to hold the MSIC that the issuing body proposes to issue; and
4) gives the issuing body a statutory declaration stating that, since the expiry of the old visa, none of the information given in relation to the application for the old MSIC has changed.
Complete a statutory declaration form outlining the details of the visa renewal, confirm that there has been no change to your circumstances since your initial MSIC application and have it signed by a relevant authority.
Once your documents have been received, a link will be sent to your employer, for them to complete your operational need letter. This must be provided by your employer, to confirm that you still have an operational requirement to hold an MSIC.
Payment details are to be advised via this link.
You will need to provide some form of valid government issued photo identification when lodging your request for replacement MSIC.
This can be your Passport, Driver's Licence, Proof of Age Card etc.
You will need to provide a clear colour copy of your Passport and any documentation from the Department of Home Affairs that refers to your new visa or permanent residency.
Additionally, the MSIC office will complete a Visa Entitlement Verification Online (VEVO) with the Department of Home Affairs in relation to your right to work.
Note: That you can use an expired Passport, if you have not yet travelled on your new Passport or transferred your Visa. If you do supply your expired Passport, you will need to provide additional photo ID for your replacement.
The replacement cost for your Visa Extension MSIC is $65 (GST inclusive).
Payment details will be provided via the operational need letter.
If your employer is incurring the cost of the replacement card, and is an approved Pilbara Ports account holder, then a purchase order can be provided. Pilbara Ports will invoice the company accordingly. Otherwise, credit card details can be taken over the phone.
If your employer is not incurring the cost then you will be required to pay for your replacement. Your nominated MSIC office will contact you for payment once all documents have been received. Payment can be made by EFTPOS or credit card.
Complete the below form with your current details. You will then need to upload copies of your statutory declaration, new Visa documentation, Passport and photo ID. You can then select which office you wish for your replacement to be sent to, either Dampier or Port Hedland. This will be where you collect your MSIC from, once it has been processed.
